The company argued that prolonged regulatory uncertainty has subjected digital asset businesses to enforcement actions without an established federal framework governing market participation. Its letter maintained that defined standards would protect investors, encourage responsible innovation, and reduce incentives for companies and skilled workers to relocate abroad.

Broader industry pressure has also intensified, with Stand With Crypto reporting 950,000 contacts between supporters and federal lawmakers by July 22. Crypto exchange Coinbase (Nasdaq: COIN) CEO Brian Armstrong described the proposal as ready for Senate consideration and predicted floor action could arrive within weeks.

Committee Approval Opens a Narrow Route to the Senate Floor

The Senate Banking Committee advanced H.R. 3633 through a bipartisan 15-9 vote on May 14 following nearly one year of negotiations. Committee leaders presented the measure as a framework for stronger consumer safeguards, clearer operating standards, and federal tools addressing misconduct across digital asset markets.

Grayscale characterized the legislation as a comprehensive rulebook that could determine whether crypto capital markets develop primarily inside the United States. Its analysis warned that failing to act before the recess could leave the proposal competing with midterm election priorities during the remaining congressional calendar.

Vote Math and Regulatory Divisions Shape the Outcome

Legislative uncertainty remains elevated after Galaxy Research reduced its estimated probability of enactment during 2026 from 50% to 30%. The 616-page package contains 104 numbered sections addressing market structure, custody, enforcement, stablecoins, government ethics, developer protections, and safeguards for people holding assets directly.

U.S. Securities and Exchange Commission (SEC) Chair Paul Atkins has expressed optimism that Congress will pass the legislation, while emphasizing regulatory clarity for exchanges, issuers, and investors. The proposal would allocate oversight responsibilities between the SEC and Commodity Futures Trading Commission, replacing overlapping expectations with defined federal roles.

Remaining procedural work requires lawmakers to combine provisions developed through the Senate Banking and Agriculture committees before resolving differences with the House-approved version. Grayscale identified that reconciliation process, limited floor time, and the need for bipartisan support as central obstacles separating committee approval from final enactment.
